Welcome to On Deck

These Terms of Service ("Terms") govern your use of On Deck, Love On Deck, and all other products or services from On Deck Society, a Delaware Public Benefit Corporation ("On Deck," "we," "us," or "our"). By creating an account or using our platform, you agree to these Terms.

On Deck Society operates as a Public Benefit Corporation with a mission to foster meaningful human connections through transparent, user-controlled, consent-based discovery. We believe you should control who you see AND who sees you, without algorithms deciding your fate.

1. Eligibility

1.1 Age Requirement

You must be at least 18 years old to use On Deck. By creating an account, you confirm that you are at least 18 years of age. We verify this through your provided birthdate during registration.

1.2 Legal Capacity

You must have the legal capacity to enter into a binding agreement. If using our services on behalf of an entity, you affirm that you have authority to bind that organization to these Terms.

1.3 Prohibited Users

You may not use any On Deck products or services including Love On Deck if you:

• Are required to register as a sex offender
• Have been previously banned from our platform

2. Your Account

2.1 Registration

To use any On Deck products and services including Love On Deck, you must create an account with accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials.

2.2 One Account Per Person

Each person may maintain only one active account. Creating multiple accounts to circumvent bans, manipulate the platform, or deceive other Lovers will result in termination of all accounts.

2.3 Account Security

You are responsible for all activity that occurs under your account. Notify us immediately at support@ondeck.id if you suspect unauthorized access.

3. Your Deck (Profile)

3.1 What Is a Deck?

Your "deck" is your profile for Love On Deck—a pitch deck-style presentation of who you are. Users of Love On Deck are called "Lovers." Unlike traditional dating profiles, your deck tells your story across multiple slides covering your basic info, interests, values, and more.

3.2 Required Information

To complete your deck and secure a Lover # (your unique member number), you must provide:

• A valid email address
• Your birthdate (for age verification)
• Your gender identity
• Your location (city)
• At least one photo
• A bio

3.3 Demographic Information

Your deck includes demographic information (such as gender, ethnicity, religion, education, and location) that powers our ViSi filtering system. You control the visibility of this information:

• All demographic information can be used for ViSi filtering, whether visible or hidden
• You choose what information is displayed on your deck and which remains hidden
• Hidden demographic information is never visible to other Lovers viewing your deck—it only affects filtering
• Demographic information locks for 30 days upon being set/changed to curb manipulation

This "private but filterable" approach means you can be discoverable to the right people without publicly displaying sensitive personal details.

3.4 Accuracy

All information in your deck must be truthful and accurate. Misrepresenting your identity, age, relationship status, or other material facts violates these Terms and may result in account termination.

4. The ViSi System: Vilters and Silters

4.1 How It Works

Love On Deck uses a unique bidirectional filtering system called ViSi:

• Vilters (Visibility Filters): Control who can SEE you
• Silters (Search Filters): Control who YOU see in discovery

This means both Lovers must pass each other's filters before either can view the other's deck. No algorithms. No recommendations. Just mutual preference matching. We call this consent based discovery because nobody can even see you're on the platform if you have filtered them out via Vilters so you don't have to worry about unwanted attention from unsuitable potential partners.

4.2 Your Control

You have complete control over your Vilters and Silters. You can adjust them at any time to change who appears in your discovery feed and who can find you.

4.3 No Guaranteed Results

While our ViSi system is designed to surface compatible matches based on your stated criteria, we do not guarantee any particular outcomes, matches, or connections.

5. Matching & Messaging

5.1 Matching

Any Lover can send a single initiating message to another Lover whose deck they can view. A match occurs when that Lover replies. Messaging is unlimited between matched Lovers.

5.2 Message Content

You are solely responsible for the content of your messages. Messages must comply with our Community Guidelines. We reserve the right to review messages in response to Lover reports.

5.3 No Guaranteed Response

We work to deliver all messages promptly, but we do not guarantee responses from other Lovers.

6. Subscriptions and Payments

6.1 Subscription Required

Love On Deck requires a subscription to access full platform features. Early adopters (first 5,000 Lovers) receive discounted or complimentary access based on signup order.

6.2 Founding Member Pricing

Early adopters receive special pricing tiers:

• First 1,000 Lovers ("Founding Members"): Free Premium accounts for life
• Lovers 1,001–2,500 ("Early Adopters"): Discounted Premium account pricing for $4.99/month for life
• Lovers 2,501–5,000 ("Pioneers"): Discounted Premium account pricing for $8.99/month for life
• Lovers 5,001+ ("Standard"): $9.99/month for a Basic account or $19.99/month for a Premium account

6.3 Payment Processing

Payments are processed through our third-party payment processor. By providing payment information, you authorize us to charge the applicable fees.

6.4 Refunds

Subscription fees are generally non-refundable except as required by law. If you believe you are entitled to a refund, contact support@ondeck.id.

6.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

7. Lover Conduct

7.1 Prohibited Activities

You agree not to:

• Harass, stalk, threaten, or intimidate any Lover
• Post false, misleading, or deceptive information
• Impersonate any person or entity
• Use On Deck for commercial solicitation, advertising, or promotion without our consent
• Collect or harvest Lover data without authorization
• Circumvent, disable, or interfere with security features
• Use automated scripts, bots, or scrapers
• Violate any applicable law or regulation

7.2 Reporting Violations

If you encounter a Lover violating these Terms or our Community Guidelines, please report them through the in-app reporting feature or email support@ondeck.id.

8. Content and Intellectual Property

8.1 Your Content

You retain ownership of content you submit to Love On Deck ("Your Content"). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute Your Content in connection with operating and promoting our services.

8.2 Our Content

All content, features, and functionality of Love On Deck—including but not limited to text, graphics, logos, icons, images, audio, video, software, and the ViSi filtering system—are owned by On Deck Society and protected by intellectual property laws.

8.3 Trademarks

"On Deck," "Love On Deck," "On Deck Society," "Lovers," "Silters," "Vilters," and "ViSi" are trademarks of On Deck Society. You may not use our trademarks without prior written consent.

9. Privacy

Your privacy matters to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

10.1 No Warranty

On Deck and all its products and services including, but not limited to, Love On Deck are provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10.2 No Guarantee of Matches

We do not guarantee that you will find matches, dates, relationships, or any particular outcome from using our service.

10.3 Lover Interactions

We are not responsible for the conduct of any Lover, whether online or offline. You assume all risk when interacting with other Lovers.

10.4 Background Checks

We do not conduct criminal background checks on Lovers. We encourage you to use caution and good judgment when interacting with others.

11. Limitation of Liability

To the maximum extent permitted by law, On Deck Society and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of On Deck and all its products and services including, but not limited to, Love On Deck.

Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal legal action, you agree to contact us at legal@ondeck.id to attempt to resolve any dispute informally. We will work in good faith to resolve the matter within 30 days.

12.2 Binding Arbitration

If we cannot resolve a dispute informally, you and On Deck Society agree to resolve any claims through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will take place in Phoenix, Arizona.

12.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, collective action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12.4 Exceptions

Either party may bring claims in small claims court if the claims qualify. Either party may seek injunctive relief in any court of competent jurisdiction for intellectual property infringement or unauthorized access to our services.

12.5 Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

13. Termination

13.1 By You

You may delete your account at any time through your account settings or by contacting support@ondeck.id.

13.2 By Us

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

• Violation of these Terms or our Community Guidelines
• Conduct that is harmful to other Lovers, us, or third parties
• Conduct that violates applicable law
• Extended periods of inactivity

13.3 Effect of Termination

Upon termination, your right to use On Deck and any of our products and services including, but not limited to, Love On Deck ceases immediately. We may delete your account data in accordance with our Privacy Policy.

14. Modifications

We may modify these Terms at any time. Material changes will be detailed through the platform or via email. Your continued use of any On Deck products and services including, but not limited to, Love On Deck after changes become effective constitutes acceptance of the revised Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and On Deck Society regarding your use of On Deck and any of our products and services including, but not limited to, Love On Deck.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
